Abstract
Nelson Diaz (1947- ) is a Philadelphia attorney who served on the Philadelphia County Court of Common Pleas (1981-1992) and as general counsel for the federal Department of Housing and Urban Development (1993-1996). In addition, he has been highly active in the Hispanic and overall Philadelphia community as an activist, businessman, and journalist. He has served on many boards and committees in the Philadelphia area, and his interests and involvement have ranged from youth groups to the Temple University Hospital to the William Penn Foundation. This extensive collection documents Diaz's activities relating to Hispanic issues, organizations, and events; his work with and for various boards and committees; his work as a judge and an attorney; and his numerous other activities. Materials include correspondence, memos, minutes, reports, transcripts, by-laws, mailing lists, financial data, petitions, clippings, personnel documents, photographs, and audio and video cassettes.

Scope and Contents

In this subseries are papers Diaz produced, gathered, and received as part of his daily work routine. This subseries is divided into two groups: departmental and committee papers, and personnel files. The latter group, which contains items like employee applications, résumés, and appointments/terminations/transfers reports, is closed to researchers. Departmental and committee papers includes memos on court procedures, financial data, schedules, reports, and correspondence relating to Diaz’s various committee assignments. There is a significant amount of meeting materials (agendas, references, and minutes) from Diaz’s work with the Criminal Procedural Rules Committee, as well as a group of correspondence, memos, and schedules related to his successful Judge “Pro-Tem” Program, which gave attorneys the chance to experience the legal system from the judge’s perspective.

Scope and Contents

This subseries contains official papers, such as opinions, orders, decisions, and findings and conclusions produced during trials of the Court of Common Pleas or higher Pennsylvania courts. There are over forty folders of Diaz’s opinions and orders from 1982 to 1993. Additionally, there are several folders of documents related to various city-wide asbestos cases presented to the court in the 1980s. This subseries also contains a few restricted folders.

C. Correspondence, 1980-1995 

Scope and Contents

The subseries, which is broken down into two groups, judicial and general, is comprised of Diaz’s correspondence with his co-workers and outside people and organizations. The first group is arranged by correspondent, and each folder contains incoming and outgoing letters. The vast majority of these letters originated during Diaz’s term as administrative judge, Trial Division. The second group contains letters from various organizations as well as Diaz’s personal and miscellaneous correspondence, invitations, and notes. The personal correspondence falls into two categories: loose letters, notes, and cards that were filed according to occasion (birthday, condolence, thank you, miscellaneous, etc.) and correspondence that had been separated into incoming or outgoing groups. Notably, in this group there is a folder of letters and pamphlets from “Enjoying Marriage,” a couple’s retreat, which provides a rare glimpse into Diaz’s personal life. There is one folder of restricted material in this subseries.

Scope and Contents

This subseries richly documents Diaz’s extracurricular activities that directly or indirectly relate to his work with the Court of Common Pleas. For instance, there are a few folders of materials pertaining to Diaz’s interest in expanding Hispanic-controlled media, and a group of news clippings and articles underscoring Diaz’s accomplishments and those of his colleagues. This subseries also contains a guide Diaz created to his court rulings, and sizable groups of correspondence and meeting materials from the Pennsylvania Conference of Trial Judges and the Philadelphia Bar Association. In addition, there are letters, forms, and financial data from Diaz’s 1981 run for Court of Common Pleas judge, as well as election petitions from his bid for Justice of the Supreme Court of Pennsylvania.

There are also materials in this subseries that highlight Diaz’s legal work abroad. In 1987, Diaz was chosen to participate in an exchange program sponsored by the U.S.-Japan Foundation. He was the first U.S. magistrate chosen for such a program. Along with other program participants, he spent “two months reviewing the Japanese legal system from both the country’s Supreme Court and from a [private] law firm.” Diaz met with local business and governmental leaders, held and attended legal and judicial lectures, witnessed Japanese legal customs and traditions, and learned about Japan’s demanding legal education system. Diaz took extensive notes and recorded his observations on micro-cassette tapes. The cassette tapes are in Series 8 while the written transcripts are in this subseries. Other materials, some written or printed in Japanese, that detail Diaz’s trip to Japan include Japanese legal references, reports from workshops and conferences, correspondence, and extensive news clippings. There are two folders of restricted materials in this subseries.

In 1990, Diaz was awarded a Fulbright Scholarship and went to Peru as a law teacher. During his nine-week stay, Diaz coordinated and led legal workshops and seminars for law students, judges, and lawyers, met with local leaders to offer advice on reforming Peru’s judicial and penal systems, and in the process learned first hand about the Peruvian legal system. The items (some in Spanish) in this subseries that document this trip include Diaz’s personal notes and writings, teaching materials, correspondence, and Fulbright applications and program guides.

This small subseries contains organizational correspondence, invitations, and speech notes that are indirectly related to Diaz’s judicial work. For instance, the folder entitled “Gospel Businessmen’s Fellowship banquet” contains a faith-based inspirational speech Diaz presented to this organization about community relationships and development. There are also folders of speeches Diaz addressed to the Community College of Philadelphia, the Labor Council for Latin American Advancement, and the World Conference on Soviet Jewry. In this subseries, one will also find the remarks Diaz gave at his swearing-in ceremony to the Court of Common Pleas. Interestingly, researchers will find multiple copies of similar speeches in these folders, for it seems Diaz often re-used parts of his speeches to form different presentations.

Scope and Contents

This subseries is comprised of materials relating to Diaz’s work with Temple University’s School of Law. There is a folder of correspondence from 1977 from Temple’s Law, Education, and Participation Project (LEAP). This interdisciplinary project was designed to help teach law to non-lawyers. Diaz, then executive director of the Spanish Merchant’s Association, was a LEAP regional advisory board member. From around 1982 to about 1992, Diaz taught Introduction to Trial Advocacy at Temple School of Law. In these folders are lecture notes, handouts, syllabi, and memos. Folders of student/teacher evaluations, grade lists, and student transcripts are closed to researchers. There is also a folder of miscellaneous memos and correspondence and a folder of notes, references, and forms from Temple’s 1984 Herman Stern Moot Court Competition, which Diaz helped judge.

In 1997, Diaz offered to represent Temple University to restructure a loan with Summit Bank. However, since Diaz had a sustained relationship with Temple a conflict of interest arose, and Diaz could not be involved with the case. The materials in this small subseries pertain to this legal venture and include memos, correspondence, budgets, conflict search papers, and various legal documents. Separated into four folders are materials sent to Diaz prior to the conflict of interest search. There is also a “Statement of Qualifications” sent from Blank Rome LLP to Temple University and the University Health System indicating that Blank Rome had maintained a working relationship with the university.

Scope and Contents

This small series is comprised almost entirely of calendars, memos, phone logs, and travel vouchers that document Diaz’s work and whereabouts as U.S. Dept. of Housing and Urban Development (HUD) General Counsel. Diaz served as General Counsel from 1993 to 1997 and traveled extensively, as indicated by the calendars and vouchers. Notably, the HOPE VI training session material in this series stands out from everything else primarily because the date (1998) falls outside Diaz’s HUD term. While it seems Diaz did not attend this session, as general counsel he did work to rejuvenate the HOPE VI program which provides housing assistance for the elderly.

A. Legal papers, 1992-2004 

Scope and Contents

In this series, one will find materials from Diaz’s legal work as city solicitor. One of his duties in this position was to provide legal advice in official matters. Thus, a large amount of the materials in this subseries consists of advice he wrote for various individuals, companies, and city departments on issues ranging from tax problems to building and land development to employee rights and responsibilities. The folder of his advice of counsel is currently closed to researchers.

Also in this subseries are a number of case briefs relating to Pennsylvania Senate Bill 1100. This case (the “Convention Center Case”) questioned the constitutionality of this bill, which Philadelphia officials believed would adversely affect the City of Philadelphia if enacted. The bill involved changing the governing body of the Pennsylvania Convention Center and transferring authority over taxis to the Philadelphia Parking Authority (PPA), as well as granting the PPA other powers. Mayor Street and the City of Philadelphia argued that the bill would harm the city’s hospitality industry as well as their ability to bargain with unions. They claimed that this bill was stealthily introduced to the Senate and not given enough time for consideration.

This subseries consists of correspondence written to or by Nelson Diaz. However, much of this correspondence is not directly related to his duties as city solicitor. Included in this series are a large number of holiday greeting cards, invitations to various events, and congratulatory or condolence letters. Also included are letters, invitations, and speeches relating to the September 2002 unveiling of a judicial portrait of Diaz commissioned for the Philadelphia Court of Common Pleas. The unveiling corresponded with National Hispanic Heritage Month, which was appropriate as Diaz is considered a role model for the Hispanic community. The portrait was then placed on permanent display in City Hall. In this group are also a few restricted folders.

Within this subseries one can also find several examples of correspondence to and from various other noteworthy politicians. Among the letters of congratulations are letters to and from former Vice President Walter F. Mondale and Ed Rendell, Pennsylvania governor and former mayor of Philadelphia. Also included are invitations to Rendell’s 2003 gubernatorial inauguration. In addition, among the portrait unveiling materials is a letter from U.S. Senator Arlen Specter of Pennsylvania.

This small subseries of eighteen folders is comprised mostly of legal and court document that Diaz created or retained while at Wolf, Block, Schorr and Solis-Cohen. There are agreements Diaz worked on for various clients, lengthy memos between Diaz and his colleagues concerning different legal matters, and several folders of Diaz’s court notes and references. Of note are several folders of court documents from Duke v. Parcs Steam-Sales Division, et al. (ca. 1980), a lengthy case which involved on-the-job injuries and company neglect. Also in this subseries is correspondence, such as that from the Philadelphia Bar Associations’ Young Lawyers Association, of which Diaz was a member. A. Governmental organizations, 1977-2011 

Scope and Contents

In this subseries, one will find materials from several city, state, and national governmental organizations with which Diaz was centrally involved. As a member of the Pennsylvania Supreme Court Committee on Racial and Gender Bias in the Justice System, Diaz played a key role in the study of bias in the state’s court system. This committee studied several types and instances of bias in order to fulfill its mission. In this collection is a comprehensive set of materials produced by the committee through meetings, discussions, hearings, and reports. Other governmental bodies that Diaz worked with include several Philadelphia police task forces, the Free Library of Philadelphia, and the Girard Independent Committee. Additionally, under the national heading are a few folders of White House Fellows materials, such as Diaz’s “dayminder” and telephone and alumni directories.

Another large group of materials in this subseries is from the U.S. Small Business Administration (SBA). Diaz worked primarily within SBA’s Region III, headquartered in Philadelphia, Pennsylvania, and covering the states of Pennsylvania, Delaware, Maryland, Virginia, and West Virginia. In addition to being a member of SBA’s Executive Committee since 1997, Diaz volunteered on its National Advisory Council from 1997 to 2000. Diaz also worked with the SBA in the early 1980s; however, the materials represented in this collection cover the years from 1997 to 2001.

At the local level, Diaz spent several decades working with various commissions and boards of the Philadelphia Police Department. He usually accepted voluntary appointments, as with the Police Corruption and Police Discipline task forces, rather than official board assignments. The materials in this collection refer to his work with the aforementioned task forces, as well as with earlier task forces for minority employment and police hiring. All of the material related to police task forces and boards is currently closed to researchers.

Scope and Contents

This large subseries contains materials from Diaz’s current and former public and private board memberships. Diaz actively served on and contributed to all the boards listed in this subseries. His memberships are numerous, and have included, at the local level, the Greater Philadelphia Billy Graham Crusade, the Hispanic Association of Contractors and Enterprises, the Philadelphia Commission on AIDS, the Police Athletic League, the Puerto Rican Week Festival, and the William Penn Foundation. The list of Diaz’s memberships with national organizations, such as the Asociación Nacional Pro Personas Mayores (National Association for Hispanic Elderly) and Midwest/Northeast Voter registration and Education Program (now called the United States Hispanic Leadership Institute), is just as lengthy. Scope and Contents

This subseries, broken down into four groups, highlights Diaz’s involvement with the Democratic party from the late 1990s to early 2000s. Most of the materials relate to Diaz’s professional persona as a Democratic supporter, and there is little that documents his personal reasons for involvement with this party. However, it is evident that Diaz’s political stance was based on his own beliefs, background, and his work with and for Hispanic causes.

Scope and Contents

Diaz served as chair of the DNC Hispanic Caucus from around 1998 to 2001. His primary responsibilities were to inform caucus members of major issues within the 2000 Democratic national campaign, to arrange caucus meetings and events, and to provide support for Hispanic voters at large. Scope and Contents

This group contains mostly materials Diaz collected while working on the “Gore 2000” campaign, such as letters, memos, articles, press releases, and campaign flyers, cards, and other ephemera. Diaz helped secure campaign donations, organized local Democratic rallies, and especially informed Hispanic voters about Gore’s work with the national Latino community. Other interesting items include campaign bumper stickers and a DNC research report entitled “100 Days of Bush: A Guide to What He has Done, Undone, and Not Done in His First 100 Days.” A smaller amount of material in this group is dedicated to Diaz’s other campaign commitments, including his support of Terry McAuliffe for DNC chair.

Scope and Contents

This group begins with materials pertaining to the Democratic National Convention of 2000 held in Los Angeles. The two folders contain correspondence, a report, member lists, travel plans, emails, and receipts. From these materials were removed several photographs of Diaz at the convention, most notably of him speaking to the delegation. These photographs can be found in Series 8. Also in this group are several folders of materials from DNC Executive Committee meetings, of which Diaz was a member. These materials show, through reports, lists, and memos, how the convention was put together, from the planning stages through the aftermath. There are also folders devoted to meetings of various committees and groups, including the Voting Right Institute (VRI). Formed by the DNC after the 2000 elections, VRI seeks to protect voter’s rights and supports solutions to questionable voting conditions, methods, and counting practices.

B. United States Hispanic Leadership Institute (USHLI), 1997-2002 

Scope and Contents

Diaz joined the United States Hispanic Leadership Institute’s (USHLI) Board of Directors in January 1997. While researchers will find USHLI materials in other series in this collection, the USHLI materials contained in this sub-group primarily relate to Hispanic voting rights and needs with the approach of the 2000 elections. There is some overlap in the materials between the time Diaz was elected to the USHLI Board (early 1997) and his selection to the DNC (late 1997). Notably, some of the early USHLI correspondence in Box 154, Folder 5 is on the letterhead of its predecessor, the Midwest/Northeast Voter Registration Education Project, which changed its name to USHLI in December 1996. There are packets of agendas, minutes, and references from Board of Directors’ meetings, financial statements, and reports on Latino voting trends. This subseries contains a minor amount of Spanish-language material.

C. Local and regional campaigns, 1991-2011 

Scope and Contents

This subseries contains memos, correspondence, press releases, and meeting materials from Diaz’s work with the “Rendell for Mayor” (1991) and “John Street for Mayor” (1999) campaigns. Diaz served as a primary member of both Rendell’s and Street’s transition teams. Under John Street, Diaz was responsible for finding suitable team members, organizing meetings, and recruiting staff for Street’s cabinet. Among the papers from this transition team are memos and correspondence, articles, agendas, organizational charts, and résumés. There is also a book of briefing materials Diaz prepared for Street Transition Team members to help acquaint them with their duties, the mayor’s responsibilities, and the work of various city departments. Also in this group are a few folders of materials dealing with other political campaigns such as Carl McCall’s bid for New York governor and Bronx Borough President Fernando Ferrer’s run for mayor of New York City.

VIII. Audio-Visual Materials, 1981-2008 

Scope and Contents

This series consists of photographs, audio and video cassettes, and computer disks. The photographs and computer disks take up one folder. Most of them include Diaz and are publicity shots. There are candid photographs of Diaz with Billy Graham and his entourage, and of Diaz in various social situations. Most of the older black and white images are taken of Diaz as a judge of the Court of Common Pleas or with different organizations. There are few photographs taken at the 2000 Democratic National Convention in Los Angeles. Most of the photographs are unlabeled; however, a few are labeled by hand on the reverse.

All of the audio and video cassettes have been transferred to CD or DVD format. The digital transfers are boxed with the original media. Researchers should use the CDs or DVDs. On the CDs is a sampling of Diaz’s speeches. One such speech Diaz gave at Southern Home Services (SHS), a Philadelphia child welfare agency. He relayed troubling statistics about Hispanic youth and urged SHS to delegate resources to helping this population. Diaz also recorded a draft of his 1981 acceptance speech when he was elected a judge to the Court of Common Pleas. There is also a recording of his actual acceptance speech Diaz gave upon his election to the Court. Finally, Diaz recorded several diaries of his travels to Peru (re: Fulbright Scholarship), Israel (re: Soviet Jews), and Japan (re: Japan Society Fellowship).

The first DVD contains three videos transferred from VHS. The first is a recording of a 1991 Christmas party attended by members of the Court of Common Pleas, including Nelson Diaz, who handed out awards to his colleagues. The second DVD contains three features. The first is entitled “Girard in Vogue,” a fashion show prepared by Girard College students in 1997 or 1998. The second item is a 1995 press conference given by the mayor of Miami, Florida, featuring HUD General Counsel Diaz. Diaz was in Miami as part of a larger tour of various communities around the country, and he announced that city would receive a sizable HUD grant. Last on this DVD is a short feature on the Hispanic Heritage Youth Award winners of 1999. Through voiceovers and statements by the winners themselves, viewers learn about the awards’ different categories and each award winner’s talents.

Also on DVD, transferred from U-matic cassettes, is a talk given in Philadelphia by Dr. Samuel Betances, a vibrant inspirational speaker, that was taped for a local television show. Diaz appeared as an introductory presenter for Dr. Betances, who spoke on the topics of diversity, Hispanic culture, and educating Hispanic youth. Some of Dr. Betances’ lecture is in Spanish.
